All orders accepted by Sweet-a-Fayre are subject to these Terms and Conditions of sale.

Booking Terms:
£50.00 non-refundable deposit fee is required at time of booking. (Non-refundable after 14 days from date of payment, to comply with a 14 days ‘cooling off’ period).  A booking form will accompany our T&C’s and this needs to be checked, signed and returned as soon as possible.  The contract will be formed between us once the deposit has been paid.

If the deposit payment hasn’t been paid within 7 days of the booking form being sent, then the date will become available again on a first come first served basis.  No date will be saved just on a signature on the booking form. 

The balance is due 4 weeks prior to the event date, or an agreed date between the two parties.  We accept payment by Cash, Cheque, Card Payment, Direct Transfer or PayPal.

Dry Hire /Glass Hire Agreement/ Breakage Charge (Sweet Carts):
All glassware/ equipment that is delivered to your event by Sweet-a-Fayre will be collected by us at an arranged date and time after the event.   If you are hiring on behalf of a business or organisation you confirm that you have the necessary authority to enter into this contract on behalf of that business or organisation, and that you will indemnify us against all losses and expense which may be incurred if this is not the case.

You will make all reasonable efforts to ensure that the glassware/equipment is not damaged or misused during the period of the hire. This includes ensuring that the glassware/equipment can safely be used with any other items which you use.   You shall not sell or attempt to sell or otherwise dispose of the glassware/equipment belonging to Sweet-a-Fayre.

You shall reimburse us for all costs in connection with replacing glassware/equipment that is not returned in good condition, pay us the full retail cost of any glassware/equipment which is lost stolen or damage beyond economic repair, and insure the glassware/equipment against such liability or a breakage deposit can be arranged and will be refunded after the event if all glassware/equipment is found as we left it.  A ‘breakage’ deposit may be a compulsory requirement depending on the service and this will be discussed at the time of the initial enquiry.

You and your guests should ensure that children are suitably supervised to avoid sweets being chosen which could pose a choking risk. This is especially important for children aged 5 years and under. Similar care should also be taken to ensure children’s safety relating to plastic bag packaging to avoid any risk of suffocation.

All other equipment:

All other equipment which is attended and served by Sweet-a-Fayre will be Sweet-a-Fayres responsibility, unless this is deliberately vandalised, or mis-treated by your guests i.e., fallen into, pulled upon, or items stolen, then all damages will be recharged to the persons(s) that are responsible for the booking.

Delivery:
All Pick n Mix Cart/Stands/Candy buffets are delivered and set up by Sweet-a-Fayre, on a date and time specified by the client.  All serviced/manned items i.e. Popcorn/Candyfloss/Waffles etc a delivery time will have been agreed by Sweet-a-Fayre and the person responsible for the booking.

Our estimated time for delivery will be discussed and agreed upon. We hope to deliver within these estimates but occasionally delays will occur despite our best efforts. We will not be liable for any delay or failure to deliver within such estimated timescales.  We will however keep the necessary people/venues up to date.

Our staff new need to be advised in advance if there are stairs to encounter on site where we will be loading / unloading hire equipment. If the elevator on site is not functioning or has limited space restrictions, we will also need to be aware of this in advance.

Installation:
Where we are unable to set up through error or fault on your part, we reserve the right to charge for our time our ‘Extra Hours or Standing Charge’ rate is £50.00 per hour 

Be advised that Fun Foods that involve cooking on site (Popcorn, Churros, Crepes, Waffles) will produce heat. Please arrange with the venue to locate these machines in well-ventilated rooms with high ceilings so as not to affect any smoke alarms. Sweet-a-Fayre cannot be responsible for any smoke alarm / fire alarm going off at the venue and affecting the event and any or items on site (evacuation, time delay, sprinkler system, etc). Contact Sweet-a-Fayre in advance if you have any concerns over this prior to the event.

We reserve the right to not accept an order or to cancel an order, even if service is taking place if there is reason to suspect staff may be at risk of physical or verbal abuse. No refund will be issued in the instance.

Allergens & Food Intolerances:

We expect to be informed of any known allergies or food intolerances at the time of booking.  We always endeavour to offer alternatives where possible to cover all possible allergies/intolerances. 

Some manufacturers have many sweets/foods from many different sources, and we are aware of the serious health risk to people who are allergic to whole peanuts, nuts or nut derivatives. While we cannot take responsibility that the products that we supply will not have traces of nuts, we do check and hold full ingredients lists from all our sweets/foods which can be viewed upon request). 

If we are supplying sweets/foods that we know contain nuts or any of the other allergens these will be clearly labelled and stored separately from all other products.  All our sweets are handled with hygiene gloves. Gloves will always be changed if handling any foods containing the allergens.  If you do require any specific information about a certain product then please contact us and we will do our best to answer any queries that you may have.

Acceptance of Terms:
By placing an order for goods from Sweet-a-Fayre, you are deemed to have accepted and agreed to our terms and conditions. English law applies to all transactions.

Cancellation Fees:

Up to 12-weeks prior to the event - Deposit

Less than 12 weeks prior to event - 50% of total cost 

Less than 8 weeks prior to event - 75% of total cost

Less than 2 weeks prior to event - 100% of total cost

Anyone wishing to cancel must contact us as soon as possible on 07790 467948 or 01246 559898 and follow up in writing (email is acceptable [email protected].). Failure to comply with our Cancellation Terms could result in legal action being taken.

If your booking can be transferred to a different date then providing Sweet-a-Fayre are  available the booking will be honoured like for like at the original booking price (delivery charges may be added).  If Sweet-a-Fayre are not available then the above cancellation terms apply. 

Insurance:

For your peace of mind, we strongly recommend that a suitable insurance be taken out by yourself to cover all eventualities and all dry hire equipment is the responsibility of the customer during the hire period.  No insurance is provided by Sweet-a-Fayre for loss, damage or theft.

Complaints:
In the unlikely event of any dissatisfaction on your part, then you must inform Sweet-a-Fayre within 5 working days of the event. We reserve the right to refuse compensation with any complaint made after the 5 working days period. Please make your complaints in writing to  [email protected] no later than 5 days after the event.

Privacy Policy/Data Protection/Copy Right:
We guarantee that your details will not be disclosed to third parties. We hold your details under the Data Protection Act 1998. These are only used by us to deliver your services. You can request removal of your details at any time. 

Photos of our products may be taken at the events that we attend for promotional purposes. Our staff will only take photos of our items and services, with or without the guests using the products. If you would not like images of your event to appear on our website/social media, please advise the member of staff attending the event on site and request that the photos not be shown.  If you wish to have a copy of the photos we have taken at your event for personal use (strictly not for business use) then email [email protected] and we will send you copies by email.

Limitation/Disclaimer Liability:
We cannot accept responsibility for loss or damage of the Pick n Mix Cart/Stand/Candy Buffets/Equipment once they have been delivered and set up at a venue, you are responsible as the hirer for any items which are not then manned by Sweet-a-Fayre.  Please note that because our products are edible, food items are non-returnable.

Sweet-a-Fayres total liability for any claim howsoever arising shall not exceed the price of the goods supplied by Sweet-a-Fayre to the customer.
Please note that any pictures shown previous to booking with us are for general illustration only (although all pictures are of previous Sweet-a-Fayre’s bookings, and the product may vary from that shown. We will however Endeavour to replace any unavailable product with a similar item.

To the fullest extent permissible under English law, we will not be liable for any losses you incur arising out of or in connection with the hire of the Pick n Mix Cart/Stand/ Candy Buffets/Services.   You agree to indemnify us at all times in respect of all claims by any person in relation to any injury, loss, claim or expense arising out of or in connection with the use of the Pick n Mix Cart/Stand/ Candy Buffets/Equipment or Services.

In no event shall Sweet-a-Fayre be liable to you for any compensation (although a full refund may be granted) resulting from, or related to, any failure or delay to provide service under this agreement if such delays of failures are due to strikes, weather, fires, riots, acts of god, theft, terrorism, or vandalism or other causes beyond our control, as defined by standard practices in the industry.  We will not be liable for any losses incurred due to Force Majeure. Such failure or delay shall not constitute a default under this agreement.  

Governing Law:   The contract between Sweet-a-Fayre and the Customer shall be governed by and interpreted in accordance with English Law and the English Courts shall have jurisdiction to resolve any disputes between us.
